Estos términos aplican al uso de la aplicación móvil Costa y del sitio web costapr.app (juntos, "Costa"). Al descargar, abrir o usar Costa, aceptas estos términos. Si no estás de acuerdo, no uses Costa. These terms govern your use of the Costa mobile app and the costapr.app website (together, "Costa"). By downloading, opening, or using Costa, you accept them. If you do not agree, do not use Costa.
1. Qué es Costa, y qué no es1. What Costa is, and what it is not
Costa es una guía informativa sobre condiciones de playa en Puerto Rico. Reúne datos públicos de agencias oficiales y los presenta en lenguaje claro, incluyendo un resumen numérico ("Costa Score") y veredictos en una frase. Costa is an informational guide to beach conditions in Puerto Rico. It gathers public data from official agencies and presents it in plain language, including a numeric summary (the "Costa Score") and one-sentence verdicts.
Costa no es un instrumento de seguridad. No es un salvavidas, no es un aviso oficial, y no es una fuente autorizada para decisiones de vida o muerte. Nuestro propio lema lo dice: una guía, no un salvavidas. Costa is not a safety instrument. It is not a lifeguard, it is not an official warning, and it is not a source to rely on for life-or-death decisions. Our own motto says it: a guide, not a lifeguard.
2. Los salvavidas y las autoridades mandan2. Lifeguards and authorities come first
Si un salvavidas, una bandera en la playa, el Servicio Nacional de Meteorología (NWS), el Departamento de Recursos Naturales y Ambientales, un municipio o cualquier autoridad indica algo distinto a lo que muestra Costa, obedece a la autoridad, no a la app. Una bandera en la arena le gana a cualquier número en una pantalla. If a lifeguard, a flag on the sand, the National Weather Service (NWS), the Department of Natural and Environmental Resources, a municipality, or any other authority says something different from what Costa shows, follow the authority, not the app. A flag on the beach beats any number on a screen.
3. De dónde salen los datos, y sus límites3. Where the data comes from, and where it falls short
Las lecturas de Costa se calculan a partir de fuentes públicas, identificadas dentro de la propia app en cada lectura, incluyendo entre otras: NOAA y el Servicio Nacional de Meteorología (pronósticos, alertas, radar, boyas, mareas), CARICOOS (boyas, modelo de oleaje costero, pronóstico de sargazo, estaciones satelitales), laboratorios de calidad de agua (Departamento de Recursos Naturales y Ambientales, Surfrider Foundation, Programa del Estuario de la Bahía de San Juan), Copernicus/CAMS y Open-Meteo (polvo del Sahara y pronóstico meteorológico), y Google (fotos y reseñas de lugares). Costa's readings are computed from public sources, each one named inside the app next to the reading it feeds. They include, among others: NOAA and the National Weather Service (forecasts, alerts, radar, buoys, tides); CARICOOS (buoys, the nearshore wave model, the sargassum forecast, satellite stations); water-quality laboratories (the Department of Natural and Environmental Resources, the Surfrider Foundation, and the San Juan Bay Estuary Program); Copernicus/CAMS and Open-Meteo (Saharan dust and weather forecasting); and Google (place photos and reviews).
Esos datos:That data:
- pueden fallar, atrasarse o estar incompletos: los sensores se dañan, los modelos se equivocan, los laboratorios muestrean con días de diferencia; can fail, run late, or arrive incomplete: sensors break, models get it wrong, and labs may sample days apart;
- son estimados o promedios en muchos casos: un modelo de oleaje no ve cada ola, y una muestra de bacteria describe el agua del día en que se tomó, no la de hoy; is often an estimate or an average: a wave model does not see every wave, and a bacteria sample describes the water on the day it was drawn, not the water in front of you today;
- no están destinados a uso legal ni de navegación. Varias de nuestras fuentes (incluyendo CARICOOS) lo declaran expresamente en sus licencias, y esa misma limitación aplica a todo lo que Costa publica. No uses Costa para decisiones legales, de navegación, comerciales ni profesionales. is not meant for legal or navigational use. Several of our sources (CARICOOS among them) say so expressly in their licenses, and the same limitation extends to everything Costa publishes. Do not rely on Costa for legal, navigational, commercial, or professional decisions.
Costa procesa, combina y resume estos datos con criterios propios. El Costa Score y los veredictos son opinión editorial calculada, no mediciones directas ni certificaciones. Costa processes, combines, and summarizes this data by its own criteria. The Costa Score and its verdicts are computed editorial opinion, not direct measurements and not certifications.
4. Asunción de riesgo4. Assumption of risk
Entrar al mar conlleva riesgos reales e impredecibles (corrientes de resaca, oleaje, rayos, bacterias, fauna marina, cambios súbitos de condiciones) que ninguna aplicación puede eliminar ni predecir por completo. Going into the ocean carries real, unpredictable risks: rip currents, surf, lightning, bacteria, marine life, conditions that turn in minutes. No application can remove those risks or fully predict them.
Al usar Costa aceptas que la decisión de entrar al agua, y todos los riesgos asociados, son tuyos. Evalúa siempre las condiciones con tus propios ojos, atiende tu nivel de destreza, y ante cualquier duda, no te metas. By using Costa, you accept that the decision to enter the water, and every risk that comes with it, is yours. Always judge the conditions with your own eyes, know your limits, and when in doubt, stay out.
5. Sin garantías5. No warranties
Costa se ofrece "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluyendo sin limitación garantías de exactitud, puntualidad, disponibilidad, comerciabilidad o idoneidad para un propósito particular. No garantizamos que Costa esté libre de errores ni que sus datos reflejen las condiciones reales de ninguna playa en ningún momento. Costa is provided "as is" and "as available," without warranties of any kind, express or implied, including, without limitation, any warranty of accuracy, timeliness, availability, merchantability, or fitness for a particular purpose. We do not warrant that Costa is free of errors, or that its data reflects the actual conditions at any beach at any moment.
6. Limitación de responsabilidad6. Limitation of liability
En la medida máxima que permita la ley aplicable, Costa, su creador, colaboradores, proveedores de datos y auspiciadores no serán responsables por ningún daño (directo, indirecto, incidental, consecuente, lesión personal o muerte) que surja del uso o la imposibilidad de uso de Costa, o de la confianza depositada en cualquiera de sus lecturas, veredictos o avisos. To the fullest extent permitted by applicable law, Costa, its creator, contributors, data providers, and sponsors shall not be liable for any damages of any kind, whether direct, indirect, incidental, or consequential, including personal injury or death, arising out of the use of, or the inability to use, Costa, or out of reliance on any of its readings, verdicts, or notices.
Algunas jurisdicciones no permiten ciertas limitaciones de responsabilidad; en esos casos, la responsabilidad de Costa se limitará a la medida máxima permitida por ley. Some jurisdictions do not allow certain limitations of liability; where that is the case, Costa's liability is limited to the fullest extent the law allows.
7. Privacidad7. Privacy

- Costa no vende datos de usuarios, y no recopila datos atados a tu identidad.Costa does not sell user data, and collects no data tied to your identity.
- La ubicación del dispositivo, si la autorizas, se usa únicamente para ordenar las playas por cercanía y no se transmite ni almacena en nuestros servidores asociada a ti.Your device's location, if you grant access to it, is used only to sort beaches by distance, and is never transmitted to or stored on our servers in association with you.
- Usamos analítica anónima de uso (pantallas visitadas, funciones usadas) para mejorar la app.We use anonymous usage analytics (screens visited, features used) to improve the app.

8. Propiedad intelectual8. Intellectual property
El diseño de Costa, su marca, el Costa Score y sus textos son propiedad de su creador. Los datos subyacentes pertenecen a sus fuentes respectivas y se usan bajo sus licencias públicas. Las fotos de playas provienen de Google y de sus contribuidores. Costa's design, its brand, the Costa Score, and its texts belong to Costa's creator. The underlying data belongs to its respective sources and is used under their public licenses. Beach photos come from Google and its contributors.
9. Cambios al servicio y a estos términos9. Changes to the service and to these terms
Costa puede cambiar, suspender o descontinuar cualquier función en cualquier momento. Estos términos pueden actualizarse; la versión vigente estará siempre en costapr.app/terminos con su fecha. El uso continuado de Costa tras un cambio constituye aceptación. Costa may change, suspend, or discontinue any feature at any time. These terms may be updated; the current version, with its date, will always live at costapr.app/terminos. Continuing to use Costa after a change means you accept it.
10. Ley aplicable10. Governing law
Estos términos se rigen por las leyes del Estado Libre Asociado de Puerto Rico, sin dar efecto a principios de conflicto de leyes. These terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-law principles.
